The LMAA was delighted to collaborate with the London Branch of the Chartered Institute of Arbitrators for a seminar entitled Offshore Wind Farm Disputes on 2 December 2021.
The hybrid event was very well attended, both in person and online. Dr RV Ahilan of ABL described recent developments in wind farms and looked to the future of the technology, drawing on his extensive experience in the offshore sector. Krista Lee QC of Keating Chambers offered an excellent analysis of some key legal issues, particularly in relation to the standards of performance required in contracts. Mary Anne Roff of Clyde & Co shared her experience of contracts, including an interesting comparison between the contract arrangements for offshore oil & gas projects and wind farms. LMAA President David Steward commented on the choice of dispute resolution clauses in wind farm projects and the use of the (non-institutional) LMAA Terms and Procedures, not only in the standard BIMCO forms, but also more widely in the industry. The panel was expertly chaired by Ben Giaretta, Chair of the CIARb London Branch.
